Job Summary:

Our ideal Labor Compliance Specialist candidate will work closely with the Labor Compliance Manager and is responsible for accurate monitoring, processing, and recording, of the submitted Certified Payroll Records (CPR) in compliance with California Prevailing Wage Rate, Federal Davis-Bacon and Related Acts, and Union Master Labor Agreements as applicable.Organize and track all data relevant to payroll and labor compliance in LCPtracker database. Effectively and promptly, address and resolve all payroll and labor compliance discrepancies with the involvement of relevant department as needed.
DUTIES AND RESPONSIBILITIES:
- Gather, analyze, and prepare Labor Compliance information for project start-up.
- As required monitor tracking application including the Department of Industrial Relations (DIR System.
- Monitor submitting of certified payroll and edocuments in LCPtracker database.
- Audit Subcontractor Certified Payroll Reports for discrepancies.
- Verify that the Union Monthly Contributions for various trades are paid.
- Verify the correct subcontractors craft payroll Union Fringe Benefit Statements.
- Verify the subcontractors Division of Apprenticeship Standards or California Apprenticeship Council base hourly rate.
- Audit for compliance with all Federal and State labor compliance laws and regulations as they relate to subcontractors craft payroll requirements.
- Verify the difference between multiple subcontractor crafts and their respective official wage determination.
- Verify the subcontractor total hourly fringe rate (Vacation/Holiday, Health/Welfare, Pension, etc.).
- Verify the subcontractors Total Deductions for employee’s federal tax, Federal Insurance Contributions Act (FICA), Social Security and Medicare, Sate Tax, State Disability Insurance (SDI), etc.
- Organize all information in department’s workspace filing system.
- Monitor the Labor Compliance e-mail account pertaining to your projects.
- Call subcontractors as well as notify subcontractors in writing of all unresolved discovered discrepancies.
- Communicate to Labor Compliance Management in writing of any compliance exposure of a significant nature to Bernards.
- Communicate and interact with all internal Bernards Department relative to the status of project labor compliance issues with a Customer Service Mindset (CSM).
- Notify Bernards Accounts Payable Department to hold payment of subcontractors who do not comply with labor compliance requirements.
- Immediately return phone calls, emails or other inquiries from both internal and external constituents with a Customer Service Mindset (CSM).
- Verify subcontractor compliance with Skilled Workforce Requirements (SWR).
- Verify subcontractor compliance with Project Labor Agreements (PLA) and or Construction Workforce Agreements (CWA).
- Participate in weekly status meetings.
- Perform other duties as assigned.
Preferred Experience, Education, and Skills:
- Bachelor of Science in Construction Management, Civil Engineering, Architectural Engineering, or related field.
- Over 4 years of Labor Compliance experience in the construction industry.
- Excellent written and verbal communication skills.
- The ability to develop, maintain, and strengthen partnerships with others inside or outside the organization who can provide information, assistance, and support.
- Ability to efficiently manage time, workload, prioritize and maintain a sense of urgency.
- Ability to handle sensitive, confidential matters.
- High attention to detail.
- Maintain competency in relevant software applications, while being able to perform ones job successfully and effectively utilizing packages and tools.
- The ability to keep functioning effectively when under pressure and maintain self-control in the face of hostility or provocation.
- Maintain a sense of responsibility to do one's best work. Accountable for one’s own actions. Focused, dedicated and committed to producing good results.
