Job Summary:
Under the general supervision of the Deputy Director, the Staff Attorney will work with the staff to address a variety of legal matters primarily related to labor and employment litigation. This includes advising staff and handling arbitration cases; legislative drafting or technical support; addressing legal issues arising under state and federal law; providing advice, counsel, and assistance on internal governance issues, such as internal elections; develop, initiate, assist and defend litigation in state and federal courts and state and federal administrative agencies; and address labor relations questions. May also provide coordination and leadership with outside attorneys handling cases assigned to them, as well as the legal proceedings and national issues affecting the UPW.
Primary Duties & Responsibilities:
· Advises UPW officers and staff concerning legal rights, obligations, and privileges.
· Represents UPW, its staff and members before courts and administrative agencies.
· Examines grievances and legal data to determine advisability of defending or prosecuting a grievance/lawsuit and may serve as agent in various transactions.
· Provides legal assistance to UPW on issues arising out of internal union matters including jurisdictional disputes under the AFSCME and AFL-CIO constitutions and union security issues, and objections by non-members to payment of certain fees.
· Performs legal research and prepares legal briefs and memoranda.
· Drafts, prepares, and files in the appropriate forum legal arguments, declarations, applications, motions, and appeals.
· Supervises, coordinates, and participates in activities affecting litigation.
· Reviews, revises, manages, and incorporates work done by paralegals and other staff of the Legal Division
· Supervises Legal Division staff.
· May be required to use own vehicle for business-related errands.
· Performs other duties as assigned.
Required Skills & Abilities:
· Knowledge of Lexis and/or Westlaw.
· Knowledge of labor unions and labor law.
· Ability to prepare legal briefs, develop strategy and arguments and prepare for presentation.
· Ability to represent clients in court and other administrative proceedings.
· Ability to advise officers, and other member clients concerning internal affairs.
· Ability to confer with colleagues in areas of specialty to establish and verify basis for legal proceedings.
· Ability to interpret laws rulings and regulations affecting labor unions.
· Ability to supervise and coordinate activities of subordinate legal personnel.
· Strong writing skills required.
· Work independently with minimal supervision and with project deadlines.
· Maintain a positive working relationship with others.
Minimum Qualifications:
· Graduation from an accredited law school with relevant legal experience.
· Admission to bar and membership in good standing.
· Proficient with Microsoft Office or other related software.
· Knowledge of or ability to attain a comprehensive understanding of UPW/AFSCME's functions, services, and programs.
· Experience which provided exposure to UPW/AFSCME operations and activities also preferred.
Valid Hawaii Drivers’ License and personal vehicle required
